1. SCOPE OF WORK
Contractor agrees to furnish labor and equipment to install one (1) above-ground swimming pool and related improvements at the above address in accordance with manufacturer specifications and applicable Texas building standards.

2. CUSTOMER RESPONSIBILITIES
Customer agrees to:
• Provide clear access to installation site
• Call Texas 811 and mark underground utilities
• Obtain HOA/municipal approvals if required
• Remove obstacles (fences, pets, debris, landscaping)
• Provide water and electrical access
Contractor is not responsible for delays caused by access restrictions, permitting, weather, or soil conditions.
3. SITE CONDITIONS & GROUND PREPARATION
Customer acknowledges East Texas soil conditions (clay, sand, slope, moisture) may require additional grading, fill, drainage work, piers, or retaining systems.

Contractor is not responsible for settling, shifting, erosion, drainage issues, flooding, or subsurface conditions after installation.
4. DECK CONSTRUCTION TERMS
If deck construction is included:
4.1 Materials
Deck will be constructed using:

Handrails, stairs, gates, skirting, and fascia will be included only if specified in Scope of Work.
4.2 Structural Standards
Deck framing shall meet manufacturer recommendations and applicable Texas residential construction practices but is not engineered unless expressly stated.
Contractor is not responsible for soil movement, settling, erosion, or shifting affecting deck stability after completion.
4.3 Permits & Code Compliance
Unless otherwise stated, Customer is responsible for obtaining permits and inspections. Contractor will construct deck to typical residential safety standards but is not liable for future code changes or inspection interpretations.
4.4 Finishing & Appearance
Natural wood materials may crack, warp, fade, cup, or discolor due to moisture, heat, or sun exposure. These conditions are not defects.
Staining, sealing, painting, or waterproofing is not included unless specifically listed.
4.5 Load & Use
Decks are designed for residential use only. Contractor is not responsible for overloading, commercial use, hot tub placement (unless specified), or modifications by others.
5. SPA / HOT TUB INSTALLATION TERMS
If spa installation is included:
5.1 Electrical & Plumbing
Customer is responsible for licensed electrical connections, breakers, bonding, and disconnects unless expressly included.
Contractor is not responsible for utility delays or electrical code upgrades.
5.2 Structural Support
Spa placement on decks requires written structural approval. Contractor is not responsible for damage caused by spa weight, water displacement, or structural overload unless deck is expressly engineered for spa load.
5.3 Equipment & Operation
Contractor installs spa per manufacturer specifications but does not warrant heater elements, pumps, jets, blowers, control systems, or covers — manufacturer warranties apply.
Customer is responsible for proper chemical balance, winterization, drainage, and maintenance.
5.4 Temperature & Energy Use
Contractor is not responsible for heating performance, energy costs, insulation efficiency, or temperature retention affected by climate, wind, placement, or customer use.
6. EXCLUSIONS
Unless expressly stated, the following are excluded:
• Electrical, plumbing, gas, or trenching
• Permits or inspections
• Fencing or enclosures
• Tree removal or excavation beyond basic leveling
• Deck staining, sealing, or waterproofing
• Water hauling or chemical balancing
• Landscaping restoration
7. PAYMENT TERMS

8. CHANGE ORDERS

10. WARRANTY
Contractor warrants workmanship for ______ months from completion.
Manufacturer warranties apply separately to pool structure, liners, pumps, filters, heaters, spas, and accessories.
Warranty does not cover:
• Acts of God (flooding, storms, freezing)
• Soil movement or erosion
• Chemical damage
• Customer misuse or neglect
• Wood movement, cracking, fading, or weathering
11. DAMAGE & LIABILITY
Contractor is not responsible for:
• Underground utilities not properly marked
• Landscaping disturbance
• Drainage or water flow changes
• Soil instability or ground movement
• Damage caused by third-party trades
Customer agrees to indemnify and hold Contractor harmless from claims arising from site conditions, improper use, or unauthorized modifications.
12. SAFETY & USE
Customer agrees to comply with Texas safety regulations, fencing ordinances, and manufacturer safety guidelines.
The contractor is not responsible for accidents, injuries, or damages that occur after installation completion.
13. CANCELLATION
3- Day “Cool-Off” right to cancel. Cancellation must be done in writing to avoid penalties. Otherwise on a case-by-case basis:
Before materials ordered, the Deposit is forfeited
After materials delivered: Customer is responsible for full material costs plus restocking, delivery, and labor charges.
14. DISPUTE RESOLUTION
This Agreement shall be governed by Texas law and venue shall lie in PARKER County, Texas.
15. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement and supersedes all prior communications. Modifications must be in writing and signed by both parties.
